MODERNA SUING BioNTech & PFIZER - EXPECTED HONOURING IP RIGHTS

MODERNA'S RIGHTS INFRINGED THE MESSENGER mRNA TECHNOLOGY  

Moderna is filing infringement cases at the Regional Court of Düsseldorf - Germany.and U.S. District Court in Massachusetts against BioNTech and Pfizer.


Lawsuits Filed in America and Germany against PFIZER AND BioTech

Moderna announced that it is suing rival BioNTech and Pfizer on grounds of infringement of the patent.

The allegation subjects to the usage of the technological key features of Moderna which it developed during the production of Covid-19 vaccination. Further, Moderna claims that its infringed patents relate to the period between 2010 to 2016 when it filed patent rights registering technology -RNA/mRNA messenger technology.

Moderna, BioNtech, and Pfizer, all three had mRNA technology Covid19 vaccinations which is a novel way of developing vaccines.

Before, the vaccines involved using viruses for developing shots to trigger an immune response.

But in mRNA technology, the messenger RNA instructs genes to produce a protein which then stimulates immune receptors to respond.

Moderna, back in October 2020 during the pandemic hours, pledged not to enforce its covid19 patents and maintained the same in March 2022. It further assured of not enforcing covid-19 patents in the low & middle economy nations but expected its competitors to honor its intellectual property rights which Moderna alleges, was not respected by Pfizer & BioNTech.

Moderna does not intend to eliminate competitors but rather seeks monetary damages.
It is filing infringement cases at the Regional Court of Düsseldorf - Germany. and U.S. District Court in Massachusetts against BioNTech and Pfizer.

On the other side, Pfizer's spokesperson confirmed being fair and confident in their stand relating to the intellectual property concern assuring that Pfizer shall defend itself till the end.
